These Terms of Service (“Terms”) constitute an agreement between you (referred to as “you”, “your”, “Renter” and “Buyer”) and Bambi Tods, LLP (referred to as "Company," "we,", "us" or our”). They regulate your use of the website www.bambitods.com, any related subdomains, and any other site where these Terms of Service are posted. This agreement encompasses all the terms and conditions, including any additional policies referenced within ("Terms of Service"). "You" refers to both users of our Website and those engaging with our sale of toys and toy rental services offered through our Website (referred to as "Services"). 

Before you begin using the Website or Services, we urge you to carefully read these Terms of Service. By accessing the Website or using the Services, or by accepting or agreeing to these Terms of Service when presented with the option, you are acknowledging and consenting to comply with these Terms of Service. If you do not wish to agree to these Terms of Service, you should refrain from accessing or using the Website and Services.

About the Services

Introduction

Bambi Tods offers two types of services: 

  1. Toy Rental subscription service (“Membership”)
  2. A e-commerce service (“Sales” and “Resale”)

Depending on your selected plan, you will receive a set number of items ("Products") each month. Your toy rental subscription covers delivery (except for North and West Regions in Singapore, please refer to the *Regions of Singapore chart below) as well as returns and maintenance to keep the items in good condition. However, it does not include expenses related to damage, loss, or theft of the item. You are responsible for any additional charges required to compensate Bambi Tods for the loss of use and the cost of the item. As for purchases of brand new items and pre-loved goods, delivery charges may be applied depending on the minimum purchase amount and location of delivery.

Singapore’s map is categorised into the following regions:
North Region: Woodlands, Sembawang, Simpang, Mandai, Yishun
North-East Region: Ang Mo Kio, Serangoon, Hougang, Sengkang, Punggol, Seletar
East Region: Pasir Ris, Tampines, Paya Lebar, Bedok
Central: Bukit Timah, Queenstown, Bukit Merah, Downtown, Tanglin, Novena, Toa Payoh, Bishan, Kallang, Geylang, Marine Parade, Marina South, 
West Region: Pioneer, Boon Lay, Jurong West, Choa Chu Kang, Bukit Batok, Bukit Panjang, Jurong East, Clementi
Places that we do not do deliveries to: Tuas, Sentosa,  Changi Airport and any other restricted areas.

1. Eligibility

Please note that our Website and Services are intended for users who are 18 years of age or older. By using the Website, you affirm that you are legally eligible to enter into a binding contract with the Company and meet the age requirements outlined above. If you do not meet these criteria, you are not permitted to access or use the Website and our Services.

2. Use of Our Services

You agree to use our services solely for lawful and appropriate purposes. You are prohibited from using our website or services for any unlawful or malicious activity.

3. Privacy 

We take your privacy seriously. Please refer to our Privacy Policy for details on how we collect, use, and protect your personal information.

We retain the right to modify, withdraw, or alter this Website and any of the services or materials provided on it, including our Services, at our sole discretion. We may restrict access to certain portions of the Website, or the Website as a whole, on occasion, exclusively for registered users.

In order to access the Website or certain resources, which encompass our Services, you might be requested to furnish specific registration information or other details. By using the Website and our Services, you are bound by the condition that all the information you provide to us or our service providers through the Website or by other means is accurate, up-to-date, and complete. The Company name, the term "Bambi Tods," the Company logo, and all associated names, logos, product and service names, designs, and slogans are trademarks owned by the Company or its affiliates or licensors. You are prohibited from using these marks without obtaining prior written permission from the Company. All other names, logos, product and service names, designs, and slogans featured on this Website are the trademarks of their respective owners.

8. Termination 

We reserve the right to terminate or suspend your account or access to our services at our sole discretion, without prior notice or liability.

We reserve the following rights:

  1. Content Control: We may, at our sole discretion, remove or reject any User Contributions for any reason or without specifying a reason or prior notice.
  2. Actions on User Contributions: We may take any action we consider necessary or suitable in our sole discretion concerning any User Contribution. This includes actions taken if we believe the User Contribution breaches these Terms of Service, such as the Content Standards, infringes upon intellectual property rights or other rights of any individual or entity, poses a threat to the safety of Website users or the public, or could potentially create legal liability for the Company.

All items rented are and will always remain the property of Bambi Tods. Items bought from us will belong to the buyer.

All online purchases and any other transactions involving the rental or sale of toys, whether conducted directly on our site or as a result of our Services, are subject to the regulations set forth in our Purchase & Toy Rental Policies and FAQ. 17. Safety Information and Associated Disclaimers 

The safety of children is of utmost importance to us. As a parent, guardian, or supervising adult utilising our Services, you bear a crucial responsibility in ensuring the safe and enjoyable use of the toys or products obtained through our Services (collectively referred to as "Toys"). When using or permitting a child to use any Toys, you acknowledge that you must adhere to the following guidelines, collectively referred to as the "Safe Handling Policies'': 

  1. Review and follow the safety and care instructions included with the Toy shipment or on the product's packaging. 
  2. Comply with all product information and instructions regarding safe handling and use that accompany the Toy. 
  3. Unwrap Toys before introducing them to children and do not allow children to play with packaging materials (including, but not limited to, plastic bags or wrappers, which could pose a suffocation risk). 
  4. Adhere to the age recommendations on each Toy, particularly to prevent small parts or other choking hazards from being accessible to children under 3 years old. 
  5. Supervise children closely during play and interactions with Toys. 
  6. Exercise caution with small parts, ropes, strings, and other potential strangulation or choking hazards that may be associated with Toys. 
  7. Promptly remove any items from play that become damaged, broken, loose, chipped, or otherwise compromised, and inform us through our email [email protected] about the damage or impairment. We are not liable for, and you release, defend, indemnify, and hold each Company-Associated Party harmless from any injuries (including fatalities), property damage, or any other costs, losses, or damages of any kind or nature to you or others resulting from failure to fully adhere to these Safe Handling Policies or from the negligent or more culpable use or handling of any Toys by anyone other than the Company-Associated Parties. You expressly assume all risks associated with using or handling Toys other than as specified by these Safe Handling Policies. 

While we make efforts to source Toys from reputable suppliers and only include Toys in our kits that we believe to be of high quality and safe for children within the specified age range, you acknowledge and agree that:
a) We do not design or manufacture any Toys.
b) We are not certified or specially qualified to conduct safety testing or quality assurance activities on behalf of you or any other individual or entity.

Consequently, to the fullest extent permitted by applicable law, you understand and agree that we do not control, are not responsible for, and do not make representations, warranties, guarantees, or indemnities regarding: 
i) The quality, safety, suitability, merchantability, or fitness for a particular purpose of any Toys.
ii) The accuracy of any advertisements, promotional materials, or statements provided by the manufacturers and/or suppliers of the Toys. 
iii) Whether any particular Toy will meet the unique needs or expectations of any specific child or user of our Services.

The presence of a Toy on or through our Services does not indicate our endorsement of the Toy for the unique needs or expectations of any specific child or user of our Services. 

Any reviews or testimonials regarding Toys or our Services are solely the opinions and perspectives of the individuals who post or provide them. These reviews or testimonials do not contain or reflect the opinions or views of the Company.
